We are a company registered under the laws of the Hashemite Kingdom of Jordan under registration number [61285], having our address at [162 madineh Munawar street]. Our website is a virtual children's toy market that can be used by Buyers who are interested in purchasing toys that are sold through our website and by Merchants/Sellers who are interested in selling toys through our Website. Our website is for buying and selling children's toys (“Products”).

These terms of use refer to the following additional terms, which also apply to your use of our Site:

We reserve the right to change or amend our Site and its content, including without limitation, adding or removing content or functionality, at any time, and without the need to notify or obtain the consent of the User of such change.

We may suspend or withdraw or restrict the availability of all or any part of our Site for business and operational reasons or any reason as we deem appropriate. We reserve the right to refuse to provide the Service to anyone for any reason at any time without the need to provide any justification or reason for such refusal.

We may transfer this agreement to someone else.

We may transfer our rights and obligations under these terms and conditions to another organization or company, at our discretion.

How to create an account?

Once You have viewed our Site, You may be asked to create an account by logging in, either by creating an account and entering all the required details, or logging in via other social media platforms, including but not limited to Facebook and/or Instagram, noting that You explicitly agree that we shall extract the required personal information to create the account from other social media applications, or by submitting the application form available on our Site.

You must keep your account details safe.

You must be at least 18 years of age to use our Site. By using our Site and by agreeing to these terms and conditions You warrant and represent that You are at least 18 years of age. We may monitor and review new accounts before You may sign in and use our Site. Providing false contact information of any kind may result in the termination of your account. Users of the Website who are Minor/ under 18 years of age, shall not register as a User of our Services and shall not transact on or use our Services.

If You register an account on our Site, You must provide accurate and complete registration information and keep this information up to date at all times, including but not limited to, any change in the mobile phone number used, change of address, or change of the email address used and we will not be responsible for any actions or omissions that have undertaken in this regard, including any damages of any kind incurred as a result of these acts or omissions. You may not register or have more than one account on the Site.

If You choose or provide You with, a pre-defined username, password, and/or answers to security questions to access the Service or any other part of the information as part of our security procedures to access the Service, you must treat such information as confidential. You must not disclose it to any third party, and it is your responsibility to keep this information confidential and not disclose it to anyone else. You will be responsible for maintaining the security of your account and you are fully responsible for all activities that occur on the account and any other actions taken and related to your account.

If you believe that someone else may know the username, password, and/or pre-defined answers to security questions or can illegally access your account in any way, you must log in to your account and change the username, password, and/or answers specified Pre-questions on security questions.

We will not be liable for any actions or omissions on your part, including any damages of any kind incurred because of these actions or omissions. We may suspend, disable, or delete your account (or any part of it) if we determine that You have violated any of these terms and conditions of use or that your behaviour or content is detrimental to our reputation and commercial reputation. If we delete or suspend your account for the previous reasons, you may not re-register to use our Services. We may block You or prevent any re-registration. We have the right to deny/cancel the access of any User and/or to disable any pre-defined username, password, and/or answers to security questions, whether You choose them or assign them to You, at any time, if we reasonably believe that You fail to comply with any of these terms and conditions of use.

Backups

We are not responsible for content residing on our Site. In no event, we are held liable for any loss of any content. It is your sole responsibility to maintain an appropriate backup of your content. Notwithstanding the foregoing, on some occasions and in certain circumstances, with absolutely no obligation, we may be able to restore some or all of your data that has been deleted as of a certain date and time when we may have backed up data for our purposes. We make no guarantee that the data You need will be available.

How You may use our Site

In connection with using or accessing the Services the User represents and warrants the following:

·         All submitted required registration information is true and accurate.

·         The User will maintain the accuracy of such information.

·         The User is not a person/legal entity or banned from receiving Services under any laws.

·         The use of the Services by the User does not violate or circumvent any laws, regulations, third-party rights, or our terms and conditions, policies, or determinations of your account status. Your Account may be deleted without warning if we believe that You have violated any of the conditions herein.

·         The User is prohibited from   distributing viruses or any other technologies that may harm the Site or the interests or property of other Users.

·         The User is prohibited from using any robot, spider, scraper, data mining tools, data gathering, and extraction tools.

We are the owner or the licensee of all intellectual property rights on our Site, and the material published on it that is related to the Site is protected by copyright laws and treaties around the world. All such rights are reserved.

You must not use any part of the content on our Site for commercial purposes without obtaining a license or approval to do so from us. If You use any part of our Site in violation of these terms and conditions of use, your right to use our Site will cease immediately.

You are solely responsible for your data. You are responsible for ensuring that your data comply with all applicable laws, guidelines, and recommendations related to the service provided. You must fully compensate us for all costs, expenses, damages, and losses, including any interest, fines, fees, or other legal or professional expenses granted against us, incurred, or paid as a result or in connection with any breach by you of your obligations under these terms and conditions.

The User may only use our Site for lawful purposes and in compliance with all applicable laws. In addition, you must abide by the following:

·         Not to use our Site to send or transmit, whether directly or indirectly, unsolicited, or unauthorized advertising or promotional material, chain letters, or pyramid selling schemes.

·         Not to use our Site for mail bombing or flooding or to make deliberate attempts to overload a system.

·         Not to use our Site to post content or link to content where the owner of that content has not consented to or authorized that posting or linking or where that posting or linking infringes the rights of that owner.

·         Not to attempt to gain unauthorized access to our Site, applications, the server, equipment, or network on which our website is stored, any server, computer, or database connected to our website or any software.

·         Not to use our Site to attempt to gain unauthorised access to any other website, internet account, server, computer, equipment, system, network, data, or information.

·         Not to use our Site to monitor data or traffic on any network or system.

·         Not to use our Site to collect or use information, including without limitation email addresses, screen names, or other identifiers, by deceit (such as phishing, internet scamming, password robbery, spearing, scraping, and harvesting).

·         Obtaining all licenses and approvals for selling the Products.

·         Having all approvals and licenses for conducting the business.

·         The account on the Site is handled by an authorized person.

·         Merchants/Sellers shall bear full responsibility and liability for selling the Products through the Website.

·         Merchants/Sellers shall sell Products with the same specifications and quality that are available on the Website.

·         Merchants/Sellers shall abide by all applicable laws and regulations and consumer protection laws.

·         Merchants/Sellers shall regularly update their data and shall remove any product listings that are no longer available.

·         Merchants/Sellers shall sell Products that are not in conformity with the law, religious values, public order, customs, traditions, and consumer dignity.

·         Merchants/Sellers shall sell Products that do not infringe the intellectual property rights of third parties.

·         Merchants/Seller shall provide enough information and specification of the Product including but not limited to, a clear photo, available quantities, price, source, weight, dimensions, and guarantee to enable the consumer to make his/her decision.

·         Merchants/Sellers shall sell Products that meet the satisfaction of the buyers and meet the description and specifications published on the Website by the Merchants/Sellers.

·         Merchants/Sellers shall provide true and accurate information and shall not hide any substantial information from the buyer.

·         Merchants/Sellers shall not sell unoriginal or forged Products.

We reserve our right to refuse, cancel the publication, and/or delete any listed product that we find violates these terms and conditions, or our policies and guidelines without prejudice to any of our other rights. 

If You breach any term of these terms and conditions your right to use our Site will immediately end. In addition, we may take such other actions including, without limitation, legal action as we consider appropriate. If You breach any term of these terms and conditions, or if we receive a request from a law enforcement authority to do so, we may report your identity, details of any breach, and any other information we consider necessary to relevant law enforcement authorities. Merchants/Sellers are aware that We have a right to sell Products that are similar and/or identical to their Products. Merchants/Sellers acknowledge that We are not a party to any sale transaction made through the Website between any buyer and the Merchant/Seller. Merchants/Sellers acknowledge that no partnership or joint venture or relation between employer and employee is created between the Merchant/Seller and the Site, Merchant/Seller is acting as an independent contractor. Merchants/Sellers acknowledge that the sale of their Products on the Website is subject to our approval, and granting such approval shall not release the Merchants/Seller from their liability towards buyers, end customers, and third parties.

We may restrict, suspend, or terminate your use and access of the Site and your Account without notice or liability to you and in our sole discretion, at any time if the following occurs:

·         You are in breach of, are attempting, or threatening to breach any of the terms and conditions herein or our policies including privacy policy.

·         Your activities on the Site violate applicable law.

·         You are unable to verify or authenticate any of your personal information; or

·         You do not, within a reasonable time of us asking for it, provide us with information that is necessary to us.

·         Merchant/Seller is in breach of, is attempting, or threatening to breach any of the terms and conditions herein or our contract signed with the Merchant/Seller.

·         Receiving negative comments or evaluations of the Merchants/Sellers or their Products.

Comments/Rating

Our Site may contain special places for the inclusion of comments and ratings of service providers from business owners who are subscribed to our Site. You undertake that you will not have any comment that is offensive to any person or entity in your comment/rating of any of the service providers and that you will not use our Site in an abusive manner to others. We reserve the right to delete your account with immediate effect if you violate any of these terms and conditions and without the need to notify You, the same shall apply to Merchants/Sellers who receive negative feedback or evaluation.

Orders

You can purchase Products from our Site. All orders are subject to acceptance and availability and in some cases, orders cannot be processed. We reserve the right to refuse or cancel any order for any given reason at any time. If we are unable to accept your order, we will inform you of this and will not charge you for the Product. This can happen because of the unavailability of the Products, unexpected limits on third-party resources which we could not reasonably plan for, or an error in the price or description of the Product. We will assign an order number to your order and tell You when your order has been accepted.

All pricing information on the Site is correct. We reserve the right to change prices and alter or remove any special offers from time to time and as necessary. The price of the Product (shall include VAT) will be the price indicated on the order pages when you placed your order. We use our best efforts to ensure that the price of the product advised to you is correct. Delivery charges or any additional fees shall be paid by the buyer which shall be displayed after completing the sale transaction.

Payment for your order may be processed immediately. You may be required to verify your identity. This verification helps us to maintain a safe place to buy and sell. By using a third-party service, you may also be subject to an agreement with the third party.

If you are paying by effecting an online payment, a validation check and authorization by the card issuer will be made and payment will be debited and cleared from your account at the time an order is made. Cardholders must retain a copy of transaction records and Merchant policies & rules.

We take care to ensure that the Site is secure and that details of your order and payment are kept confidential, but in the absence of negligence on our part, we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data  You provide when accessing or ordering from the Site.

If We receive notice that your listings or activity violates any third-party service agreement, we may at our sole discretion take action against your account to comply with their policies. Such actions may include cancelling a transaction or suspending your account.

Customer may cancel their order within 24 hours; however, a full refund will not be applicable unless We have incurred no costs/expenses concerning the order being purchased. Refunds will be made back to the payment solution used initially by the customer and any refund shall be made within 45 days from the date of cancellation acceptance. Refunds will be done only through the original mode of payment.

Return Policy

Products can be returned within two days of the date of receiving the Product by the buyer if the Products are subject to a refund as per the below refund conditions. Products that do not meet the refund conditions shall not be refunded, provided that the buyer is notified of accepting the refund application.

The Buyer shall, within two days of receiving the Product, send a refund application to the Website to the email address in the event the Product is refundable as per the below refund conditions with the details of the defect. The buyer shall be notified of the outcome of the refund application (whether acceptance or rejection) within a reasonable period and after studying the application, any needed information or documents might be requested.

Once We receive the Product, or once it is received by the Merchant/Seller refunding the price to the credit card or the e-wallet of the buyer might take (30) days.

Products that are subject to a refund within the said two days are defective, a Product is defective in the following scenarios:

·         Lack of safety requirements in the Product for normal use.

·         The Product does not meet the specifications or characteristics available on the Website.

·         Failure to achieve the declared level of performance or quality mentioned on the Website.

·         A deficiency in the Product or unsuitability for use according to what it has been prepared for.

·         The external appearance of the package indicates that the Product is defective, provided that the package is not opened, and it will be returned as a closed package. If the package is opened despite the external appearance indicates of a possible defect, the return of the Product will not be accepted.

·         If the Product is defective without any external indicator of a possible defect, the Product shall be returned with the original package, information booklet, and all accessories related to the Product (if any).

If the defect appears after using the Product for any manufacturing defect within 2 days from receiving the Product, the Product can be returned and the buyer shall be provided with the same Product if available, and if not, the buyer shall be compensated for the value of the Product.  

Products that do not meet the aforementioned refund conditions will not be refunded. Any refunded Product must be refunded in its original package if the original package is unavailable the refund can be refused. The buyer shall bear all costs and expenses related to the refund including transportation in all refund situations.

Refunded Products shall be delivered within the Hashemite Kingdom of Jordan, and refunded amounts shall be made to the accounts available in the Hashemite Kingdom of Jordan.

For Products that have not been delivered yet to the buyer, the buyer may receive the full value of the Product if cancellation is made within (7) hours from the date of completing the purchase order, in such case the value of the order shall be refunded to the buyer automatically within (30) days from the date of cancellation of the purchase order.

The above-mentioned return policy shall apply to all Users, Merchants/Sellers.

Prices

Merchants/Sellers that upload their Products for sale on our Website will be entitled to determine the selling price of the Products whilst maintaining our commission/percentage for handling the process. We reserve the right to change prices and alter or remove any special offers from time to time and as necessary. When the Product is sold, the concerned Merchant will be notified of the purchase, such notification will include the details of the purchase. Merchants shall provide accurate payment details. Any commission or deductions that may be applicable by the chosen payment method will be borne solely by the Merchant.  We reserve the right to withhold any payments to the Merchant at our sole discretion should the Merchant breach any of the terms and conditions or applicable laws without any liability to be held against Us.

Delivery

All displayed items will be delivered within Jordan. Shipping will be done by a third-party courier. Delivery within Jordan cities shall be within [2 working days]. Avoid any delivery delay by providing your full address along with your contact details.

Products

All descriptions, images, references, features, content, specifications, and prices of Products described or depicted on the Site are subject to change at any time without notice. Certain weights, measures, and other descriptions are approximate and are provided for convenience purposes only. The inclusion of any Products on the Site does not imply or warrant that these products or services will be available.

 We reserve the right to limit the quantities of any Products that are offered on the Website. We reserve the right to discontinue selling any Product at any time. Any offer for any Product made on this site is void where prohibited.

We may modify or discontinue any part of the Site; charge, or modify, the fees required to use the Site.

We reserve the right to refuse any order You place with Us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. If we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

Should You create an account to post any products or items on our Site, you will be able to determine the price at which such product or item should be sold to customers. We will disclose the percentage that will be added to your price and the final price of the Product. This price shall include the operational costs and expenses. We reserve to amend and modify the cost that we charge at any time.

Advertising

From time to time, you may be communicated with, receive communications from, be re-directed to, interact with, or participate in or use the services or obtain goods and services of or from, third parties (collectively, the "Advertisers") such as our advertisers, sponsors, or promotional partners as a result of your use of the Site. All such communication, interaction, and participation are strictly and solely between You and such Advertisers and we shall not be responsible or liable to You in any way in connection with these activities or transactions (including, without limitation, any representations, warranties, covenants, contracts or other terms or conditions that may exist between You and the Advertiser or any goods or services You may purchase or obtain from any Advertiser).

Disclaimer of warranty

We will not be responsible to You for any delay or failure to comply with our obligations under these Terms and Conditions if such delay or failure occurs due to any cause beyond our reasonable control.

You expressly agree that your use of our Site is solely at your own risk. You agree that our Site is provided on an "as is" and "as available" basis. We make no warranty that the Website will be uninterrupted, timely, secure, or error-free; nor do we make any warranty as to the results that may be obtained from the use of the Website or as to the accuracy or reliability of any information obtained through the Website. You agree that any damage that occurred to You as a result of using our Website, or purchased Products shall be at your own risk and that You will be solely responsible for any damage to You and any third party as a result of using our Website or purchased Products.

You understand and agree that any material and/or data downloaded or otherwise obtained through the use of the Site is done at your discretion and risk and that You will be solely responsible for any damage to your system or loss of data that results from the download of such material and/or data. No advice or information, whether oral or written, obtained by You from us or through the Website shall create any warranty not expressly made herein.

Under no circumstances we shall be liable to You or any person for any indirect, incidental, special, or consequential damages (including, but not limited to, damages arising from loss of profits, revenue, sales, goodwill, use of the content, or Influencing work, business interruption, loss of anticipated savings or loss of business opportunities) as a result of your granting or revoking access to your data on our Site or resulting from any interruption or suspension of Website or as a result of your actions in Cancellation, restriction and/or denial of access to your data/information or your account.

Such modifications, amendments, or deletions shall be effective immediately upon posting on the Site, as per the date of modification mentioned hereunder. Continued use of the Site following any such changes will be considered as acceptance of such changes by yourself.

We reserve the right to change or amend our Site and its content, including without limitation, adding or removing content or functionality, at any time, and without the need to notify You of such change.

All content included on the Site including, but not limited to, text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code, and software is the property of Us, our affiliates, or Merchants/Sellers. By continuing to use the Site You acknowledge that such material is protected by applicable intellectual property and other laws.

Your use of the Site and its contents grants You no right to reproduce, copy, distribute, store, or in any other fashion re-use material from the Site unless otherwise indicated on the Site or unless given express written permission to do so.

We take the protection of copyrights, both our own and others, very seriously. We, therefore, employ multiple measures to prevent copyright infringement over this Site and to promptly end any infringement that might occur. If You believe that the Site contains elements that infringe your copyrights, please contact us immediately.
